Rumor has it that Bad Brain is attempting to acquire the rights to Sam & Max: Freelance Police. What can you say about that?

No comment (I signed an NDA). All I can say is: yes, we are talking to LucasArts about a game that might involve animals, but that's all folks! I guess we will see what´s happening in March 2005 at the latest.

A German company with no track record and no ties to Sam & Max? I'll take a wait-and-see approach to this one.

Whether this is good news or not probably depends on what studio will be developing it.  Since Bad Brains have signed Autumn Moon (the new development studio formed by many ex-Lucasarts adventure guys - including a lot who worked on Sam & Max) then maybe they will be the ones making the game?  Not sure if they have the resources to start work on a second game while still doing A Vampyre Story, but it would be cool.

Its seems a bit silly when there is already an almost finished Sam and Max game waiting to be released.  It looked great too.

Thats the idea, they are working on buying the almost finished game. So resources shouldn't be much of an issue.
